Sellers - Responsibility

It is the responsibility of the seller to properly identify, by year, make and model, any vehicle brought to Dealer Trade Solutions for purposes of re-sale. The seller shall also disclose and announce any defect or condition on the vehicle that would adversely impact its value, including, but not necessarily limited to:

  • Frame, fire or flood damage.
  • Broken or nonfunctioning odometer.
  • Vehicles over mechanical limits or True Miles Unknown.
  • Salvage title vehicles.
  • Vehicles that were police, taxi or kit cars.
  • Vehicles that were used as rental cars.
  • Vehicles that have had engine changes
  • Vehicles with alternative fuel engines.
  • Vehicles that have had their VIN reassigned.
  • Vehicles that have nonfunctioning, or missing airbags.
  • Any condition or defect that would render the vehicle unsafe to drive or operate.

The seller shall also have available and provide, at time of sale, any and all necessary title documents that will enable Dealer Trade Solutions to pass a title free and clear of all liens and encumbrances. 

Dealer Trade Solutions will accept title documents from all 50 states provided they are accompanied by documents necessary to register the vehicles in the state of California.  

The following documents are not acceptable, unless announced as such.

Except for vehicles that sell for less than $300.00 

  • Duplicate title applications. 
  • Junk or salvage bills of sale.
  • Lien documents and government sale documents, such as marshal sales

Unless accompanied by a certificate of title and announced prior to sale

  • Gray market vehicles or vehicles that do not meet USA standards.
  • Foreign (non-USA) documents.
  • Paperless title certificates or transfers.
  • VIN alterations or replacements
  • Theft recovery or branded titles (example:  salvage, police, taxi, rental, kit car, lemon law and factory buy-backs, etc)

It is the sellers’ responsibility to provide title and necessary registration documents within 60 days from the date of sale.  If the title can not be produced, within the 60 days, the buyer must notify Trade Solutions and give 3 days (72 hours) for Trade Solutions to pursue the title. All expenses in obtaining the title will be charged to the seller. After the 72 hours the buyer has the right to unwind the sale if a mutual adjustment can not be reached. The vehicle must be returned in no more than 3 days from expiration of the 72 hour notice, in a condition comparable to which it was purchased.

In the event of an unwind the seller shall refund the buyer the purchase price of the vehicle and reasonable documented cost as determined by Trade Solutions, but not to exceed $300.00.  All expenses must be supported by appropriate documentation. Print-outs (KSR, Carfax, AutoCheck, CVR) must be current (obtained within last 30 days) All expenses exceeding the $300 limit are NOT subject to arbitration.  

The seller is responsible to pay all penalties associated with late titles on any vehicle sold through Dealer Trade Solutions. (Example:  DMV, ASF fees or buy fees). $300 No arbitration rule does not apply.  If a title can not be produced and the buyer approves, the title can be bonded for an amount specified by the buyer.
